Why tax return information is different

Section 7216 of the Internal Revenue Code makes it a crime for anyone in the business of preparing tax returns to knowingly or recklessly disclose or use a client's tax return information without consent, outside narrow exceptions: a fine of up to $1,000, up to a year in prison, or both. So before client data goes into any outside AI service, the question is whether that is a disclosure that needs the client's written consent. Ask your own adviser; we don't give tax-law advice.

The FTC's Safeguards Rule also names tax preparation firms among the businesses that must protect customer information with a written security program.

With a machine in your office, client data never goes to an outside AI company at all. The models run on hardware you own.

What it does for a firm

  • Ask about a client and get the answer from their files, with a link to each document.
  • Find the engagement letter, the prior-year workpapers or the notice you need, and which version is current.
  • Totals and counts across clients and engagements, from your own records.
  • At the Office level, summarise a client's whole file before a meeting and answer questions across many clients at once.
  • Separate workspaces where you need them, for example tax and advisory, each with its own document set.

What it will not do

It is not tax research or tax preparation software, and it does not file anything. It answers from your firm's own files. It does not make a firm compliant with anything. Like every AI, it is not right every time. That is why every answer links to the file or record it came from, so anyone can check it.

What does private AI cost for a 20-person accounting firm?

For 20 people, that is the Office level: $9,499 for the machine at Apple's price, $5,000 to $7,500 for the implementation and $1,500 a month for the management plan, so $32,499 to $34,999 in year one and $18,000 a year after. No per-seat fees. A firm of up to 10 people fits the Team level: $27,799 to $30,299 in year one.

Does this remove the need for Section 7216 consent?
